Heard the learned counsel for the applicant.
By means of this contempt application filed under Section 12 of the Contempt of Courts Act, 1971 non-compliance of the order dated 25.01.2021 passed by this Court in Writ-A No.33 of 2021 is complained of.
It is alleged that the order dated 09.03.2021 is in violation of the order of the writ Court dated 25.01.2021 passed in Writ-A No.33 of 2021.
Having heard the learned counsel for the applicant and having perused the record, I find that the writ Court has simply directed for consideration of the grievance of the petitioner on a representation made by him and it was found that some amount due to the petitioner and the same shall be paid. From the order dated 09.03.2021 it clearly transpires that it was not found that any the amount due to the petitioner, hence disposed of the representation rejecting the claim.
In the considered opinion of the Court, order dated 09.03.2021 is virtually in non-compliance of the order of the writ Court, therefore, no cause for contempt is made out. It is open for the petitioner to challenge the order dated 09.03.2021 in an appropriate forum, if so advised. No cause for contempt survives.
The contempt application is consigned to records.
