1. Heard Sri Anurag Tripathi, learned counsel for the petitioner and learned Standing Counsel for respondent Nos.1 to 3.
2. This writ petition has been filed seeking a direction upon respondent No.2 to initiate an inquiry against respondent no.4 who was Pradhan during the period 2016 to 2021.
3. It is conducted that respondent No.4 had committed number of irregularities during the period when she was Pradhan. As the U.P. Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules 1997 (hereinafter called as "1997 Rules") provides for inquiry against a sitting Pradhan as well as Up-Pradhan. There is no procedure prescribed for initiating any inquiry against an Ex- Pradhan.
4. In view of the above, no such direction can be issued by this Court under 1997 Rules to respondent no.2 to conduct any inquiry against an Ex-Pradhan.
5. In view of the above writ petition stands dismissed.
