This writ petitioner has been filed challenging the order dated 23.10.2017 passed by Superintendent of Police, Pilibhit, whereby, petitioner's claim for grant of compassionate appointment has been rejected.
Facts which are in issue are that petitioner's father who was a Constable in Civil Police had died on 28.12.1983. An application for grant of compassionate appointment appears to have been made and the State Government exempted limitation of five years in entertaining the application. The order has now been passed rejecting petitioner's claim on the ground that petitioner's date of birth is 07.06.1986 and, therefore, he was born after two years five months and nine days of the death of his father. It is for this reason that petitioner's claim has been treated as dependent of the deceased and the application has been rejected.
Although, counsel for the petitioner submits that the date of birth of the petitioner has wrongly been mentioned as 07.06.1986 and that petitioner was actually born on 22.03.1984, but all such plea cannot be accepted in view of the admitted fact that petitioner's date of birth in the High School record has been mentioned as 07.06.1986. Even otherwise after expiry of 35 years, it would be too late in the day for the petitioner to press an application for grant of compassionate appointment as the very object of grant of compassionate appointment to tide over the sudden difficulty for the family has outlived its purpose.
Writ petition lacks merits and it is accordingly dismissed.
