Heard learned counsel for the petitioner.
Present writ petition has been filed seeking a direction to the Civil Judge (Senior Division), Meerut to consider and decide Original Suit No. 173 of 2017, Shyam Babu Gupta Vs. Smt. Savita Devi within a stipulated period.
Submission of learned counsel for the petitioner is that the plaintiff is 70 years old and is suffering from cancer and as such his suit may be expedited.
Suit is of the year 2017. As such, I am not inclined to issue any such direction as prayed for in this petition. However, the petitioner is at liberty to move an application before the court below for expeditious disposal of the suit making all such assertions, which shall be considered by the court below sympathetically.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
