Heard learned counsel for the petitioner and learned Standing Counsel for the respondents No.1 and 2.
In view of the order proposed to be passed, notices need not to be issued to the private respondent.
The petitioner is before this Court for a direction to respondent no.2/Settlement Officer Consolidation, Mau to decide the restoration application filed by the petitioner in Appeal No.92 (Jairam Vs. Ramashankar and another) under Section 21(2) U.P. C.H. Act expeditiously within a stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to respondent no.2/Settlement Officer Consolidation, Mau to consider and decide the aforesaid restoration application pending in the appeal in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
