Heard learned counsel for the parties.
By the instant writ petition, petitioners seek following relief:
i) issue a writ, order or direction in the nature of mandamus commanding the respondents to measure the land of gata no. 521m area 0.03 dismil, gata no. 521m area 0.03 dismil & gata no. 521m area 0.03 dismil, of the petitioners situated in village Rajpur (Palliya), Pargana Sikandarpur Garvi, Tehsil Belthara Road, District Balliya within stipulated period in the light of Writ C No. 6635 of 2012 (Chandrabali v. Additional Commissioners & others) District Jaunpur passed on 07.02.2012 by this Hon'ble High Court."
It is urged that petitioners were allotted patta on 28.12.2018 (Annexure-1 to the writ petition). Grievance of the petitioner is that possession of the land has not been granted to the petitioner till date.
Learned Standing Counsel submits that the third respondent, Deputy District Magistrate, Belthara Road, Balliay, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the third respondent, Deputy District Magistrate, Belthara Road, Balliay, to consider and decide the grievance of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
