Heard Sri Rajiv Mishra, learned counsel for the petitioners, Sri Utpal Chatterji, learned counsel for the respondent no.3 and Sri A.K. Sand, learned AGA for the State and perused the record.
This petition has been filed with the prayer to quash the F.I.R. dated 18.5.2018, registered as Case Crime No.648 of 2018, u/s 420, 467, 468, 471, 323, 504, 506 IPC, P.S. Loni, district Ghaziabad.
Learned counsel for the petitioners submits that three FIR's were earlier registered against the petitioners by different persons which were challenged by them by filing Criminal Misc. Writ Petition Nos.12044 of 2018, 11189 of 2018 and 11288 of 2018 in which their arrest has been stayed by this Court in the said FIR's.
Copy of the order granting interim protection in favour of co-accused persons supplied by learned counsel for the petitioners is taken on record.
Learned counsel for the respondent no.3 opposed the prayer for quashing of the FIR and submitted that the petitioners are land mafia. Earlier FIR was registered against them for similar offences.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
