Order on Crl. Misc. (Correction) Application No.2 of 2018.
Heard Ms. Abida Syed, learned counsel for the petitioners, Sri Pawan Shukla, learned AGA for the State.
It has been argued by learned counsel for the petitioners that it appears that wrong order has been transcribed in the present petition. It is further pointed out that in similar circumstances, interim order was granted by this Court in Criminal Misc. Writ Petition No.23445 of 2018, hence the order dated 6.9.2018 passed in the present petition be corrected accordingly.
The contention of learned counsel for the petitioners is not at all acceptable as the order passed by this Court in the present petition was correct order and simply because in a similar petition, an order has been passed staying the arrest of the said accused cannot be a ground to correct the order passed in the present petition. Moreover the order which was passed in Criminal Misc. Writ Petition No.23445 of 2018 was passed on the facts and circumstances different to that of the present case and in another case which appears from the said order. Hence order dated 6.9.2018 passed in the present case requires no correction.
The correction application is, accordingly, rejected.
