JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant - original accused No.1 for suspension of sentence and regular bail.
We have heard Ms.Patel for the applicant and Mr.Pandya learned APP for the State.
Considering the evidence of eye-witnesses including injured eye-witnesses, it appears that no blow is stated to have been given by the applicant to anyone. The applicant is aged more than 60 years.
Under these circumstances, we find that it would be just and proper to suspend the sentence and to release the applicant on regular bail pending the appeal.
Hence, the following order.
The sentence imposed upon the applicant is suspended and he be released on regular bail on following conditions:
(A) He shall furnish the bail bond of Rs.20,000/- and one surety of the like amount.
(B) He shall not misuse his liberty.
(C) He shall not leave the limits of the country without prior permission of the Sessions Court.
(D) He shall surrender the passport if any with the Sessions Court.
Record and Proceedings be returned to the trial Court.
Application allowed to the aforesaid extent. Rule made absolute. Direct service is permitted.
