Learned advocate Mr.Damani submits that the petitioner herein has already started paying the amount as per one time settlement to the respondent -Company. Petitioner intends to pay up the entire amount in the next 12 weeks period. Therefore, at this stage, he seeks to withdraw this petition with a liberty to revive the same, in the event of any difficulty within 12 weeks. Such liberty is also allowed to the respondent herein also. Periodical regular payment since is being made arbitration proceedings may not be initiated for 12 weeks, however, on petitioner failing to abide by the term of one time settlement , the same shall be initiated. . On merits this Court has not expressed any opinion .
