By order dated 22.9.2016 in Writ B No. 45577 of 2016,this Court directed Settlement Officer (Consolidation) to decide the application filed by the applicant dated 4.1.2014 under Section 42-A of the U.P. Consolidation of Holdings Act, 1953 expeditiously, preferably, within a period of six months.
It seems that the Settlement Officer (Consolidation) forwarded the matter for decision to the Deputy Director of Consolidation. The Deputy Director of Consolidation by order dated 9.1.2018 sent back the records of the case to Settlement Officer (Consolidation) for decision by him. The specific case of the applicant is that no decision has been taken Settlement Officer (Consolidation) so far.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next three months. In case the compliance is still not made, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
