Heard learned counsel for the petitioner and Shri Abhishek Shukla, learned Standing Counsel appearing for State respondents. Shri Brij Kumar Yadav has accepted notice on behalf of Gaon Sabha.
In view of the order proposed to be passed, notices need not go to private respondent.
The petitioner is before this Court for a direction to the respondents to allot the land in question to the landless and poor persons.
Shri Abhishek Shukla, learned Standing Counsel raised an objection that without any material fact the petitioner has approached this Court without indicating that at any point of time the Land Management Committee (LMC) has ever proposed for allotment or there is any process going on for allotment/ settlement of lease/ patta to the landless persons.
Confronted with this situation, learned counsel for the petitioner states that liberty may be accorded to the petitioner for ventilating his grievances before the SDM concerned.
Considering the facts and circumstances, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of with observation that in case any such representation is moved before the competent authority within two weeks, this Court hope and trust that the same would be considered and decided in accordance with law expeditiously but certainly after giving opportunity to the parties concerned.
