The present application has been filed seeking quashing of the proceedings of case no.173/2012(State Vs. Shiv Prasad @ Meva Lal) pending in the court of Judicial Magistrate-3, Allahabad arising out of case crime no. 25/2012, under Sections 323, 504, 506 I.P.C. and 3(1) (x) of SC/ST Act, P.S. Lalapur, District Allahabad.
On account of compromise having arrived at between the parties, the opposite parties appears through Shri D.K. Tiwari, Advocate filed his affidavit accepting the plea that the matter has been compromised and the compromise application has been filed in the court concerned.
In view of the fact that the sections under which the case is pending are compoundable and can be quashed in exercise of power under Section 482 Cr.P.C., the proceedings of aforesaid case are quashed subject to verification of documents by the court concerned.
The parties are directed to appear before the court concerned on 19.01.2021 for verification of the signatures.
The application is accordingly disposed of.
Copy of the order downloaded from the website of Allahabad High Court shall be accepted/treated as certified copy of the order.
