Heard learned counsel for the petitioners.
Present writ petition has been filed seeking a direction to the respondent no. 2, the Civil Judge (J.D.), Gorakhpur to decide application dated 13.7.2017 (Annexure-3) filed by the petitioners under Order 39 Rule 1 and 2 CPC in Suit No. 1845 of 2016, Kumud Devi Vs. Shri Prakash and others within a stipulated period.
In the facts and circumstances of the case, the present writ petition is finally disposed of with the direction to the to expedite the hearing of the aforesaid application dated 13.7.2017 filed by the defendant petitioner herein and decide the same on its own merit, in accordance with law, expeditiously provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
