Heard Sri S.K.Kushwaha, learned counsel for the petitioner, Sri Gambhir Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondent no.3 to conduct free and fair investigation in pursuance of FIR dated 21.3.2017, registered as case crime No.66 of 2017, under Sections 406, 409 I.P.C., P.S.Surir, District Mathura and conclude the same within some stipulated time.
It has been contended by learned counsel for the petitioner that petitioner is the informant of the present case and he has come up before this Court with a prayer that direction be given to respondent no.3 for fair investigation in the matter as he apprehends that investigation is not being carried out in a fair and proper manner because the the accused Smt.Vimlesh Devi has challenged the impugned FIR before this Court in Crl. Misc. Writ Petition No.27732 of 2017 in which interim protection has been granted to her by Coordinate Bench of this Court vide order dated 15.12.2017.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
It is further directed that the S.S.P., Mathura shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
