The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 25.08.2020 passed in Matter Under Article 227 No. 2562 of 2020 (Shiv Kumar Gupta Vs. State of U.P. and another), which for ready reference is quoted as under:-
"Heard the counsel for the petitioner.
The grievance of the petitioner in the present petition is that no decision is being taken on the application dated 15.11.2019 filed before the Civil Judge (Junior Division), District Jaunpur for withdrawal of the amount deposited by the respondent-tenant under the order dated 2.12.2014 passed in Writ - A No. 65047 of 2014.
The Civil Judge (Junior Division), District Jaunpur is directed to pass appropriate orders on the application dated 15.11.2019 filed by the petitioner expeditiously, preferably within a period of three months from the date a copy of this order is produced before him, in case, there is no legal impediment in deciding the aforesaid application.
It is clarified that this Court has not expressed any opinion on the merits of the claim of the petitioner.
With the aforesaid direction, the petition is disposed of."
In the facts and circumstances of the case, the present contempt petition is disposed of finally directing the opposite party to comply with the order passed by this Court dated 25.08.2020 in its letter and spirit expeditiously but not later than three weeks' from the date of presentation of copy of this order.
It is open for the applicant that if the aforesaid order has not been complied with within the stipulated period he has a liberty to file fresh contempt petition.
