Heard Sri Lal Chandra Mishra, learned counsel for revisionist/petitioner and Sri Janardan Prakash, learned AGA for the State.
Learned counsel for revisionist/petitioner, at the outset, submits that he is aware of the fact that this revision petition against order of interim maintenance, is not maintainable. Therefore, in place of pressing this revision petition for interference in the impugned order dated 04.03.2021 passed by Court of learned Principal Judge, Family Court, Banda in Case No. 76/IX/2020 (Smt. Shilpa Gupta vs. Shirish Kurele) under Section 125 Cr.P.C., Police Station-Kotwali Nagar, District-Banda, he submits that Court of learned Principal Judge, Family Court, Banda be directed to expedite the hearing of the matter and conclude the hearing at earliest.
This prayer is not opposed by learned AGA for the State.
In view of such facts, this petition be disposed of with a direction to the Principal Judge, Family Court, Banda to decide the pending application/case of the petitioner on its own merits, referred to above, as expeditiously as possible, if possible, within a period of six months from the date of receipt of computer downloaded copy in PDF form of this order strictly in accordance with law.
In above terms, the petition is disposed off. It is made clear that this Court has not expressed any opinion on the merits of the case.
