JUDGMENT / ORDER

Mr.
Kotai, learned advocate for the petitioner, has submitted that since the Mamlatdar has submitted a report which declares that the petitioner is not undertaking activity of preparing food items in open area and is not throwing filth and left-over in open area, the petitioner desires to approach the competent authority with appropriate application in light of the said report by the Mamlatdar.
1.1 For the said purpose, present petition is not pressed, at this stage, and a request for permission to withdraw the petition is made with a view to approaching the competent authority, on the basis of the report submitted by the Mamlatdar.
2. The permission, as sought for, is granted.
3. The petition stands disposed of as withdrawn.
4. If and when any application is made on the basis of the report allegedly submitted by the Mamlatdar, then, the application may be decided strictly in accordance with law without being influenced by the fact that the petitioner is permitted to withdraw present petition and is allowed to make the application. If the reasons mentioned in the order impugned in present petition still subsist, then, the decision on the basis of said fact may be taken by the competent authority.
With aforesaid observation and clarification, present petition stands disposed of as withdrawn.
