Heard Sri N.N. Jaiswal, learned counsel for the petitioner and the learned Standing Counsel on the application for recall of order dated 11.04.2018.
The aforesaid writ petition has been disposed of vide order dated 11.04.2018 on the basis of instructions dated 07.04.2018 given by the District Social Welfare Officer, Hardoi to the office of the learned Chief Standing Counsel to the extent that the petitioner is being paid his regular salary and he has already been paid arrears of salary. Vide order dated 11.04.2018, this Court had left open for learned counsel for the petitioner to move an application if the aforesaid instructions are not correct.
Learned counsel for the petitioner has preferred the recall application dated 16.04.2018 stating therein that neither the petitioner has been paid arrears of salary nor he is being paid his regular salary. He has annexed photocopy of the statement of bank pass-book issued on 12.04.2018 wherein no amount, as submitted by the District Social Welfare Officer, Hardoi, is given to the petitioner.
Therefore in view of the above, the application is allowed and the order dated 11.04.2018 is hereby recalled. The District Social Welfare Officer, Hardoi is directed to show cause as to why the payment of arrears of salary with effect from October, 2017 and regular salary of the petitioner is not being paid despite the fact that his instructions says that the requisite permission/ approval has been granted for making payment of the aforesaid amount.
List this case on 08.05.2018 as fresh to enable the District Social Welfare Officer, Hardoi to make payment of salary to the petitioner as well as payment of arrears of salary, failing which, he shall appear in person before this Court on the date fixed.
