JUDGMENT / ORDER

Heard Mr. Pujara, learned Counsel for the petitioners. Mr. Pujara, learned Counsel for the petitioners has submitted that the petitioners have completed graduation from Gujarat Vidhyapith which is deemed university as per the provisions under the University Grants Commission Act, 1956 and that therefore the petitioners are required to be treated as graduate under the relevant rules. He also submitted that the action of respondent of not treating the petitioners as eligible for submitting application and not considering the degree held by the petitioners as sufficient compliance of the requirements of graduation is contrary to the provisions.
Learned AGP has submitted that since reference of Gujarat Vidhyapith and / or any degree conferred by the said SCA/4519/2012 2 ORDER Vidhyapith is not specifically mentioned under the Rules, the respondent cannot accept the application of th petitioners.
Having regard to the rival submissions by the contesting parties, by way of interim arrangement, it is directed that the respondent will accept the application of present petitioners which will be subject to the final order that may be passed in the petition. It is clarified that the acceptance of the application by the respondent authority will not create any right or privilege of any nature in favour of the petitioners and it will be subject to final order.
For further hearing, office is directed to place the matter on 23.4.2012. Direct service is permitted.
