Heard learned counsel for the applicant and learned A. G. A. for the State.
Applicant has moved the present bail application seeking bail in Case Crime No.459 of 2016, under Section 302 I.P.C., P.S.Handia, District Allahabad.
I have perused the prosecution story as set up in the F.I.R. and also the bail rejection order.
Perused the F.I.R. and the postmortem examination report and the order of the court below rejecting the bail application. I have also perused the statement of the daughter of the deceased Phoolgena copy of which has been annexed as Annexure-5 of the bail application contents of which are self explicit. I have also perused the order by means of which co-accused Manoj Harijan has been granted bail in which the role of the applicant has been distinguished clearly.
Looking to the seriousness of the allegation as made in the FIR, gravity of offence and the severity of punishment, no case for grant of any indulgence is made out.
Accordingly, the application for bail is rejected.
