Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Case No. 225 of 2007arising out of Case Crime No.260 of 2007, State Vs. Manoj and others, under Sections 498A, 323, 504, 506 I.P.C, Police Station Jansa, District Varanasi pending in the Court of Additional Chief Judicial Magistrate, Court no.10, Varanasi.
The submission is that the charge-sheet was submitted in the year 2007 and cognizance was taken at that time. Till date no charge has been framed in this case. Learned counsel for the applicant has submitted that the Court below may be directed to frame the charge and proceed with the trial.
Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to frame the charge in this case within a period of one month and thereafter proceed with the trial and conclude the same within a period two years without granting any unnecessary or long adjournments to either of the parties, from the date of production of a certified copy of this order, if there is no other legal impediment.
