Supplementary affidavit filed today is taken on record.
Heard learned counsel for the applicant, learned Additional Government Advocate and perused the records.
The applicant is involved in case crime no. 372 of 2017, under Section 3/5/8 Cow Slaughter Act, P.S. Simbhawali, District Hapur.
As per first information report, the applicant is involved in cow slaughtering and recovery has been made from his possession about 30 Kg of meat in a plastic bag and same was collected and sample was sent to laboratory as to whether recovered meat was cow beef or not. Laboratory report has been produced by learned AGA and from perusal of report, it does not transpire that alleged recovered meat was cow beef. Further, it is very interesting to know that the meat sample which was sent to the laboratory for examination, did not bear seal as appears from column 7 of the report. He further contended that the applicant has been falsely implicated in the present case and he is in jail since 12.10.2017.
On contrary, learned AGA opposed the prayer for bail, but could not controvert the fact that as appeared from the report itself.
Considering the aforesaid submissions of learned counsel for the parties, after seeing the meat examination report and without expressing any opinion on the merits of the case, I am of the view that the applicant is entitled for bail.
Let the applicant Shaumeen @ Munnu involved in aforesaid case be released on bail on his executing a personal bond and furnishing two sureties each of the like amount to the satisfaction of the court concerned.
It is made clear that Identity status and residence proof of the applicant and sureties be strictly verified by the court concerned before the bonds are accepted.
