Learned Additional Public Prosecutor Mr.K.T. Dave waives service of notice of Rule on behalf of the respondents.
2. The present application has been preferred for modification/deletion of conditions imposed by this Court, while enlarging the applicants on bail vide order dated 7th February,2008 passed in Criminal Misc. Application No.1535 of 2008.
3. Learned counsel for the applicants submitted that the conditions, which were imposed upon co-accused, has been modified by this Court vide order dated 28th May,2008 in Criminal Misc. Application No.5042 of 2008 and, therefore, condition nos.3(d) and 3(g) are required to be modified.
4. Having heard the learned counsel for both the sides and looking to the fact that till today, there is no breach of any of the conditions imposed by this Court vide order dated 7th February,2008 passed in Criminal Misc. Application No.1535 of 2008, the modification as prayed for is granted. Now, condition No.3(d), shall reads as under:
ýS3(d) the applicants shall mark their presence before Valsad City Police Station, on every first day of English Calendar month between 9:00 a.m. to 2:00 p.m.ýý
5. Condition No.3(g) is hereby deleted. Rest of the conditions imposed by this Court vide order dated 7th February,2008 passed in Criminal Misc. Application No.1535 of 2008 shall remain intact and as they are. Rule made absolute to the aforesaid extent. Direct service permitted.
