Heard Sri V.P. Srivastava, learned Senior Advocate assisted by Sri S.K. Yadav, learned counsel for the applicant, Sri Y.K. Singh, learned counsel for the complainant and Sri I.P. Srivastava, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that it appears that the incident has taken place in Tilak ceremony where the deceased received a single shot at the hands of the applicant. The applicant is in jail since 16.12.2015, hence he may be released on bail.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail and submitted that there was some family dispute between the applicant and the deceased on account of which the applicant shot dead the deceased by his licensee rifle which was recovered at his pointing out. The trial is in progress and the statements of three prosecution witnesses have been recorded.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Shardanand Singh @ Chandan Singh involved in Case Crime No. 1761 of 2015 under section 302/34 I.P.C., police station Garwar, District Ballia.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
