JUDGMENT / ORDER

Court No. - 40
Case :- MATTERS UNDER ARTICLE 227 No. - 1204 of 2019 Petitioner :- Sharad Nath Respondent :- Principal Judge Family Court And Another Counsel for Petitioner :- Nitin Chopra
Hon'ble Anil Kumar,J.
Heard learned counsel for the petitioner and perused the record.
As the controversy involved in the present case is trivial in nature, so the present writ petition is finally heard and decided at the admission stage.
Accordingly, notices to opposite parties are dispensed with.
Learned counsel for petitioner submits that petitioner has filed a Divorce Case No. 680 of 2013 (Sharad Nath Vs. Smt. Uchitra) in the year 2013 but the same has not been decided till date on one or other pretext without any fault on the part of the petitioner.
Accordingly, he requests that respondent No. 1/Principal Judge, Family Court, Allahabad may be directed to decide the same within stipulated time as fixed by this Court.
Thus, after hearing learned counsel for parties and going through the record as well as keeping in view the submission made by learned counsel for petitioner, the writ petition is disposed of with a direction to respondent No. 1/Principal Judge, Family Court, Allahabad to decide in Divorce Case No. 680 of 2013 (Sharad Nath Vs. Smt. Uchitra) within a period of two years, if possible, from the date of receiving certified copy of this order after hearing the parties concerned on merit.
It is clarified that this Court has not adjudicated the claim of the petitioner on merit.
