This writ petition has been filed for a direction upon the State-respondents to get the encroachment made by the private respondents over plot no.61-Ka, which was entered as a pathway, removed.
Learned Standing Counsel submits that the petitioner has an efficacious remedy of filing an application under section 25/26 and 67 of the U.P. Revenue Code, 2006 (hereinafter referred to as the 'Code').
Under such circumstances, it is directed that if the petitioner files an application under section 25/26/67 of the Code within a period of 15 days from today along with a certified copy of this order, the same shall be decided within a period of 90 days thereafter after hearing the parties concerned, if there is no other legal impediment.
The writ petition is, accordingly, disposed of.
