Heard Sri Atal Tripathi, Advocate holding brief of Sri A.C. Tiwari,learned counsel for petitioner, learned State counsel and perused the record.
Facts in brief of the present case is that initially on 08.02.1963, petitioner joined on the post of Junior Engineer in Nagar Palika Parishad, Shikohabad. On 31.02.1993, he has been compulsorily retired from services while he was posted on in Nagar Palika Parishad Sikandrarau Hathras.
Learned counsel for the petitioner submits that in spite of repeated requests and reminders, post retiral dues of the petitioner has not been paid to him, so for redressal of his grievances petitioner approached this Court by filing present writ petition with the following main prayer.
"a) Issue a writ, order or direction in terh nature of mandamus directing the respondents, especially respondent no. 2 to sanction and make payment of retiring dues to the petitioner for the post of junior engineer with effect from 01.06.1993 and onwards by calculating G.P.F., insurance, leave-in-cashment, pension arrears etc., to pay forthwith to the petitioner awarding further 18% interest on teh dues calculated thereof."
After hearing learned counsel for parties and going through the record as well as taking into controversy involved in the present case, the writ petition is disposed of with a direction to the petitioner to move a fresh representation before the respondent No. 2/District Local Bodies, U.P. VIIIth, Floor, Indira Bhawan, Lucknow within four weeks from today in respect to their grievances which he has raised in the present writ petition annexing all relevant documents and materials in support of his case and after receiving the same, respondent No. 2 shall consider and decide the same by way of speaking and reasoned order in accordance with law within a further period of eight weeks thereafter.
