Heard Shri V.K. Agnihotri, learned counsel for the petitioner and learned Standing Counsel for the State.
The petitioner has filed the Original Suit No.1607 of 2014 with the prayer for eviction of the respondents/defendants.
Learned counsel for the petitioner submits that the age of the petitioner is about 76 years. On the basis of the order sheet annexed as Annexure No.3 to this petition, he further submits that due to delay tactics of the respondents/defendants, the suit has not been decided till date.
Considered the submissions made at Bar and perused the record.
In the light of the judgment passed by the Hon'ble Supreme Court in the matter of M/s Shiv Cotex vs. Tirgun Auto Plast P. Ltd and Others reported in (2011) 9 SCC 678, this writ petition is disposed of with the direction to learned court below to decide the aforesaid suit, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order, without granting any unnecessary adjournment to either of the parties.
