Heard learned counsel for the applicant, Sri Amrit Raj Chaurasia, the learned A.G.A. for the State and perused the record.
The instant application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No. 111 of 2019, under Sections 419, 420, 467, 468, 471, 120-B I.P.C., police station Mehnagar, District Azamgarh.
The Court finds itself unable to countenance the prayer for anticipatory bail in light of the own admission of the applicant as made in a written statement filed in OS No. 1453 of 2019 in which she admits that the vendor shown as Vijay Bahadur Singh was infact some one else impersonating the selling individual. The only explanation which is proffered is that at the relevant time she did not know that the vendor was an imposter. The Court further bears in mind the fact that the applicant was the sole beneficiary of the sale deed. Learned counsel has also referred the Court to the orders passed on Criminal Misc. Bail Application Nos. 45094 of 2019 and 32842 of 2019 to submit that co-accused have been accorded the facility of anticipatory bail. However the Court notes that neither of the two orders which are referred to assign any independent reasons for grant of anticipatory bail except to note the contentions addressed. More importantly the Court notes that the written statement of the applicant which has been brought on the record of this application has neither been noticed nor considered. The prayer made is refused.
The application consequently stands rejected.
