Heard learned counsel for the petitioners and perused the record.
By means of this petition under Article 227 of the Constitution of India, the petitioners have prayed for following relief:-
"(1) direct the learned court below to decide the interim 6-C application filed by the petitioners in Original Suit No.2412 of 2019 (Shanti Devi Vs. Rajpatti Dev and others) pending in the court of Civil Judge (J.D.) Sharki, Allahabad since 6.9.2019 within some stipulated period as determined by this Hon'ble Court, as well as also direct the Respondent No.1 and 2 not to interfere in the peaceful possession of 3/4th shares (1/4th each) of the petitioners in the disputed agricultural lands i.e. Arazi No.491/4, Arazi No.73/1 area 0.2280 hectare situated at Village Sarai Abhai Chandra @ Chandauki, Pargana Sikandara, Tehsil-Phoolpur, District Prayagraj as well as in the Arazi No.770 area 0.3515 Hectare situated at Village Kanehati, Pargana Sikandara, Tehsil-Phoolpur, District Prayagraj which is the agricultural and ancestral lands of the petitioners till the disposal of 6-C application pending before the learned court below."
Considering overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid application of the petitioner filed in Original Suit No.- 2412 of 2019, strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of six weeks from the date of production of copy of this order.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
