A suit for specific performance filed by the petitioner was accompanied by an application for temporary injunction praying that the suit property be not transferred during the pendency of the suit. When the application for temporary injunction was rejected, the petitioners' Appeal was also dismissed on 4.9.2019. Aggrieved thereof, the petitioner filed the instant application under Article 227 of the Constitution of India.
No interference is warranted in the orders impugned. However, any alienation to take place during the pendency of the suit, only in consonance with the provisions of section 52 of the Transfer of Property Act.
With these observations, the petition is disposed of.
