The sole relief claimed in the instant petition is for issuing a direction to the trial Court to decide application filed by the petitioner under Order 39, Rule 2-A CPC registered as Case No. 53/2017, within a time specified by this Court.
A perusal of the order sheet reveals that the opposite party to the said proceedings is yet to be served. The proceedings have been initiated hardly six months before.
In such view of the matter, this Court is not inclined to issue any direction, as prayed for in the instant petition, but leaves it open to the petitioner to make a request for expeditious disposal of the proceedings before the trial Court itself.
The petition stands disposed of accordingly.
