At the outset, counsel for the petitioner submitted that he is pressing for a direction to the trial Court to decide his application for temporary injunction pending in Original Suit No. 5727/2017, expeditiously.
The said suit has been filed by the petitioner for cancellation and permanent injunction. An application for temporary injunction has been filed in the suit, which is stated to be pending. The trial Court by order dated 12.10.2017 declined to grant ex-parte injunction being of the opinion that defendants are required to be heard before the application is taken up for consideration.
It is not clear from the order sheet whether the defendants have been served or not.
Accordingly, the instant petition is disposed of by directing the trial Court to decide the application for temporary injunction expeditiously, soon after the defendants are served.
