The petitioners claim that their land was demarcated by order of S.D.M. Phoolpur, Prayagraj dated 26.6.2021. It is alleged that the private respondents have removed the marking stumps put by the Tehsil Authorities during course of demarcation. In this regard, there is a report of Revenue Inspector dated 30.6.2021. The petitioners have filed certain representations before respondent no.1 for taking action against the persons responsible for the same. It is alleged that no action has been taken by the first respondent on their application. The petitioners have prayed for a mandamus commanding respondent no.1 to take action against private respondents who had removed the pillars, which were fixed by the Tehsil Authorities during course of demarcation proceedings.
Learned Standing Counsel submits that respondent no.1 is competent to examine the grievance of the petitioners.
Accordingly, without expressing any opinion on merits of the case, the petition is disposed of with direction to respondent no.1 to examine the grievance raised by the petitioners in their representation dated 20.07.2021 and take remedial steps in accordance with law expeditiously, after hearing any person who is likely to be affected thereby.
