This application has been filed by the applicant with a prayer for expeditious disposal of the case pending before the S.D.M, Tehshil Harraiya, District Basti in case no.132/11/2016 (Sahabdeen and others Vs. Ram Chandra), under section 133 Cr.P.C.
Heard Sri Utsav Singh, learned counsel for the applicant and learned A.G.A for the State and perused the record.
Learned counsel for the applicant has submitted that the proceeding is pending since 2016 wherein on 28.10.2016, the opposite party No.2 was directed to remove the encroachment of a public path but the said order still has not been executed and the opposite party No.2 has not removed the encroachment.
From the perusal of the records, it transpires that the matter is being not taken by the S.D.M.Tehshil Harraiya, District Basti and the matter is being postponed by a general date and after 7.11.2018 the matter has not been taken up.
Looking into the facts and circumstance of the case as well as the urgency of the matter, the S.D.M.Tehshil Harraiya, District Basti is directed to dispose of the matter within a period of three months from the date of production of certified copy of this order.
With the aforesaid direction/observation, the instant application finally stands disposed of.
