Heard learned counsel for the applicant and learned AGA for the State-respondents.
This second bail application has been filed for enlarging the applicant on bail in Case Crime No. 64 of 2019 (S.T. No. 180 of 2019), under Section 302 I.P.C., Police Station -Ayana, District -Auraiya.
Learned counsel for the applicant could not point out any new ground except the pendency of trial which could not be a ground for granting bail. He also submitted that applicant is languishing in jail since 27.08.2019.
Learned counsel for the applicant also could not demonstrate as to whether earlier order dated 18.03.2020 passed in Criminal Misc. First Bail Application No. 11487 of 2020 has been served before the court below or not.
Considering the facts and circumstances of the case, criminal history of the applicant, the gravity of the offence, the nature of accusations and severity of punishment in case of conviction, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
However, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of six months from the date of production of computer generated copy of this order.
