Heard Sri Vikas Mani Srivastava, learned counsel for the applicant, Sri Akhilesh Kumar, Advocate has filed his Vakalatnama on behalf of opposite party no.2, which is taken on record and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing the charge sheet no.106 of 2014 in Criminal Case No.1046 of 2017, arising out of case crime no.136 of 2014, under Sections 498A, 323, 504, 506 IPC, and 3/4 D.P. Act, P.S. Mahila-thana, Meerut, pending in the court of Special Chief Judicial Magistrate, Meerut.
Learned counsel for the applicant states that the parties have settled all their disputes amicably outside the Court, yet they are ready to file a compromise before the concerned Court for quashing of the proceedings.
Learned counsel for respondent no.2 as well as learned AGA submits that the applicants be permitted to appear before the Magistrate who may verify the said compromise from opposite party no.2.
Considering the submissions made by learned counsel for the parties, the applicants are directed to file an application within two weeks from today before the court concerned for deciding the compromise between the parties. Learned Magistrate after verifying the compromise from opposite party no.2, shall pass suitable orders within eight weeks thereafter in accordance with the provisions of law.
For a period of two months from today, no coercive action shall be taken against the applicant, in the aforesaid case.
With the aforesaid observation, the application is disposed of finally.
