Shri M.M. Sahai, learned counsel appearing on behalf of the fourth respondent pointed out that the fourth respondent has been wrongly impleaded, as no relief has been claimed against him, nor any allegation has been made against him.
In view of the above, learned counsel for the petitioner seeks liberty to delete the fourth respondent from the array of the parties, which is allowed.
The petitioner's father was working as Mazdoor with the U.P. State Road Transport Corporation. He died on 10.4.2001, while in harness. The petitioner made claim for being given compassionate appointment. He was informed by the Regional Manager by letter dated 10.2.2015 that he can be given contractual appointment on the post of Conductor, provided he has passed Intermediate and his claim for regular employment shall be considered subsequently. The case of the petitioner is that in pursuance thereof, he joined as Conductor on contractual basis. He is now claiming regularisation on the post of Conductor in terms of the conditions stipulated in the letter of the Regional Manager dated 10.2.2015, wherein he was offered appointment on contractual basis until he is given regular appointment.
Learned counsel for the petitioner submitted that the petitioner has made repeated representations to the authorities but no decision has been taken so far.
Shri S.K. Misra, learned counsel appearing on behalf of respondents 2 and 3 very fairly states that the claim made by the petitioner shall be considered by the third respondent within such time as may be directed by this Court.
Accordingly, without expressing any opinion on the merit of the issues, the writ petition is disposed of with liberty to the petitioner to approach the third respondent with a certified copy of this order and fresh representation and in which event, the same shall be decided by the third respondent by means of a speaking order, in accordance with law, expeditiously and preferably within a period of next three months.
