Sri Kamla Singh, learned counsel for the applicants and learned A.G.A. for the State and perused the material on record.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the summoning order dated 17.09.2021 as well as the entire proceeding of Case No. 26389 of 2021 (State Vs. Shamim Ahmad & Others) arising out of Case Crime No.153 of 2021, under Sections 147, 148, 323, 325, 308, 504, 506 of Indian Penal Code, registered at Police Station- Kanth, District- Moradabad, pending in the court of Additional Chief Judicial Magistrate, 04th, Moradabad.
Upon considering the facts and circumstances of the case, the prayer made by learned counsel for the applicants is hereby refused.
After some arguments, learned counsel for the applicants wants to withdrawn the application with liberty to file a bail application before the court of competent jurisdiction.
In view of the above, the application is disposed of as withdrawn with liberty to the applicants to file an appropriate application for bail before the court below in terms of the decisions rendered by the Supreme Court in Satender Kumar Antil Vs. Central Bureau of Investigation & Another, Special Leave to Appeal (Crl.) No(s). 5191 of 2021 decided on 07.10.2021.
