Heard learned counsel for the petitioners and Shri Rajesh Kumar, learned Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioners are before this Court for a direction to third and fourth respondent to complete the boundary wall at demarcated land i.e. Khasra No.4-Ka and 5-Ka purchased by the petitioners through registered sale deed dated 27.6.2014 and their names have been recorded in the revenue record as per the orders dated 20.12.2017 and 6.4.2018 passed by respondent no.2 and for a direction to respondent nos.3 and 4 to comply with the orders dated 20.12.2017 and 6.4.2018 passed by second respondent within stipulated period.
Learned counsel for the petitioners states that in the present matter on the direction issued by second respondent for the purpose of erecting boundary wall on demarcated land the petitioner had also proceeded to deposit Rs.73,074/- for providing adequate police force but either one pretext or the other on spot the boundary wall could not be erected and as such this Court should come for rescue and reprieve of the petitioners.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the second respondent i.e. District Magistrate, Agra to comply his aforesaid orders expeditiously and preferably within three months from the date of production of certified copy of this order, in case there is no other legal impediment in this regard, but certainly after giving opportunity to the parties concerned.
