At the very outset, learned counsel for the respondent Sri B.K.Yadav states that petitioner has alternative of appeal under Rule 5 of Uttar Pradesh Basic Education Staff Rules, 1973 and in the event petitioner prefers appeal, the same shall be considered and decided on merits after being afforded opportunity of hearing.
In view of above, the petitioner is relegated the alternative remedy of appeal under 1973 Rules. In case petitioner approaches the appellate authority alongwith memo of appeal within a period of two weeks from today, the same shall be considered on merits and also after giving full opportunity of hearing to the petitioner the same shall be decided within a further period of six weeks.
Writ petition stands disposed of.
