Heard learned counsel for the petitioner.
Counsel for the petitioner submits that he is not pressing the relief no. 1 and he confining his prayer to the relief no. 2 only claimed therein.
This writ petition has been filed seeking the following amongst other reliefs:-
"(i) issue a writ, order or direction in the nature of Mandamus commanding the respondent no.2 to decide the recall application filed by the respondent no. 4 within stipulated period of time"
Petitioner is aggrieved on account of pendency of restoration application filed by the respondent no.4 against the mutation order passed in his favour. The restoration application is stated to be pending since 20.08.2018.
In view of the statement so made, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no.2/Naib Tehsildar Manda, Prayagraj to consider and decide the restoration application as expeditiously as possible and preferably within a period of three months from the date of a certified copy of this order is filed before him.
