JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY)
1. Rule.
Learned APP Mr. Pandya waives service of Rule.
2. By this application, the applicant - convict has prayed that he be enlarged on temporary bail for his own treatment, which he claims for his heart ailment. The certificate issued by the Medical Officer, Central Jail Dispensary, Ahmedabad dated 7.4.2012 shows that treatment is already being provided to the applicant from U.N. Mehta General Hospital. Further, certificate also demonstrates that the sickness is not such where the applicant is required to be enlarged on temporary bail.
3. Considering the totality of the facts, discretion does not deserve to be exercised and hence, the application is rejected. Rule discharged.
