The petitioner is before this Court assailing the impugned order of transfer dated 15.7.2021 passed by the respondent no. 3, whereby, the petitioner has been transferred from Prayagraj to Varanasi and all other consequential proceedings arising therefrom. With a further request to direct the respondent no. 3 to decide the representation dated 6.7.2021 within stipulated period.
Learned counsel for the petitioner in support of his submissions has placed reliance upon the judgment passed by this Court in Sameer Siddiqui Vs. State of U.P. Thru. Upper Mukhya Sachiv, Medical And Ors. (Service Single No. 16604 of 2021, dt.3.8.2021) and as such it is sought to be contended that the present matter is squarely covered by the aforesaid judgment and the similar treatment may also be extended to the petitioner.
No useful purpose will be served in keeping the writ petition pending consideration.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the writ petition stands disposed of with observation that in case the petitioner moves a fresh representation to the authority concerned ventilating his grievance within a week from today in the light of Sameer Siddiqui (supra), the authority would decide the same strictly in accordance with law and as per transfer policy in three weeks thereafter.
This order has been passed with due assistance of Sri S.K.Mishra, learned counsel for the contesting-respondent.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
