A supplementary affidavit has been filed on behalf of the petitioner stating in paragraph 7 that a compromise date 10.05.2017 between petitioner no. 3 and respondent no. 4 has been filed before Family Court.
Supplementary affidavit has been filed annexing therewith the certified copy of the compromise application filed by the parties before the court below on 27.11.2017 stating that they have already compromised their case no. 131 of 2009 under Section 125 Cr.P.C., another case no. 518 of 2018 for divorce has also been withdrawn due to compromise between the parties. The parties have divorced each other and have married third person and do not wish to proceed with the case and they have prayed that the case no. 286 of 2009 under Section 498- A, 323, 504 and 506 I.P.C. and ¾ of Dowry Prohibition Act may be dismissed.
The counsel for the petitioner has filed the present petition on behalf of the petitioner.
In view of the above, the present Criminal Misc. Writ Petition stands disposed of with the direction to the court below to pass an appropriate order in accordance with law within the period of three weeks from the date of presentation of the certified copy of this order on the compromise application dated 27.11.2017 This writ petition stands disposed of.
