Heard Shri Ramesh Chandra Upadhyay, learned counsel for the applicant and learned A.G.A. for the State.
Present application under Section 482, Cr.P.C. has been filed for quashing the order dated 29.5.2018 passed by the Judicial Magistrate, Court No.5, Agra in Complaint Case No.1553 of 2016, under Section 138, N.I. Act, P.S. Hariparwat, District Agra, whereby N.B.W. was issued against the applicant.
Prayer for quashing the non bailable warrant is refused.
The applicant is directed to appear and file an application for recall of the order dated 29.5.2018 before the concerned magistrate within three weeks from today, who shall pass an appropriate order on the said application. In case the applicant appears before the court concerned within a period of three weeks from today, no coercive action shall be taken against the applicant in the aforesaid case. In case the applicant failed to appear before the court concerned within the aforesaid period, the protection granted by this Court stands vacated.
With the aforesaid observation, the application stands disposed of.
