Heard Sri Shahroze Khan, learned counsel for the applicant, Sri Irshad Hussain, learned A.G.A. for the State and perused the record.
It has been contended by learned counsel for the applicant that statement of the prosecutrix along with other prosecution witnesses has been recorded by the trial court in which she has stated that she named the applicant at the behest of the villagers and further on account of darkness in the night, she could not recognize the applicant.
Learned A.G.A. vehemently opposed the prayer for bail and submitted that victim is minor.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Shah Mohammad involved in Case Crime No. 63 of 2018 under Section 376 I.P.C. and 3/4 POCSO Act, police station Trilokpur, District Siddharth Nagar.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same preferably within a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
