(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Through this application, the original appellants seek deletion of appellant No. 2, Mr. Dharam Narayan Rathi from the judgement dated 28.03.2012. This is on the premise that Mr. Dharam Narayan Rathi expired during the pendency of the appeal. It is stated that his heirs are already on record. In that view of the matter, we do not find it necessary to make any change in the judgment already delivered. When the question of releasing either the interest or the principle amount of compensation deposited with the Claims Tribunal arises, it would be open for the remaining appellants to bring this aspect to the notice of the Tribunal and the order for disbursement shall be made accordingly. Application stands disposed of accordingly.
