Heard learned counsel for the applicant as well as learned A.G.A.
By means of this application, the applicant who is involved in case crime no.0050 of 2021, under Section 3(1) of U.P. Gangster and Anti Social Activities(Prevention) Act, Police Station-Tiwaripur, District-Gorakhpur is seeking enlargement on bail during the trial.
Learned A.G.A submits that the applicant has got a long criminal history of 19 cases out of which, the applicant has been convicted in three cases and rest of the cases are pending against him. The applicant is languishing in jail since 05.11.2020.
Keeping in view the long criminal history of the applicant, I am not inclined to exercise my discretionary power in favour of the applicant.
